Experts urge Commission to adopt campaign finance rules relating to tax-exempt organizations

Election Law @ Moritz professors Edward B. Foley and Donald Tobin have written commentary on the proposed rules to address the topic of how federal campaign finance law applies to tax-exempt organizations (see http://moritzlaw.osu.edu/electionlaw/campaign_finance_fed11.html) and are prepared to discuss their comments further. The rules will be considered at Thursday’s (8/19) meeting of the Federal Election Commission. The proposal, according to Foley and Tobin, carefully distinguishes between two different types of tax-exempt organizations based on the extent to which, as required by tax law, they involve themselves in election campaigns.

Foley and Tobin both testified at the Commission’s hearings in April on a previous proposal concerning the same topic. In their commentary, which has been posted to the Election Law @ Moritz web site (see http://moritzlaw.osu.edu/electionlaw/index.html), Foley and Tobin urge the Commission to adopt the proposal that its General Counsel has submitted.
