Ohio State expert can discuss debate over national do-not-call list

The debate over implementing the national do-not-call list continues even after a U.S. District judge ruled last week that the Federal Trade Commission lacked authority to run the registry. Even with the judge’s ruling, President Bush signed a bill on Monday to implement the list.

David Goldberger, Moritz College of Law professor who specializes in constitutional law, says the debate over implementing the list will continue even after it is scheduled to go into effect on Wednesday. Goldberger says the federal courts have to resolve whether commercial speech has the same protection as political or other constitutionally protected forms of speech.
